Personal profile


David Bowden is a Chartered Building Surveyor who has a special interest in boundary
matters.
He obtained an ordinary degree in Land Administration at the North East London Poly-
technic, now the University of East London, in 1978.
In 1978 he started working for John Anstey BA FRICS of Anstey Horne & Co in Newbury
Street EC1, a firm well known as specialising in party wall and rights to light.
In 1982 he moved to Wilks Head & Eve in Harley Street W1, a similarly well known and
respected firm specialising in the same areas, where he worked for Anthony Leech FRICS,
Keith McDonald JP FRICS FRIBA MInstRA, and finally Eric Roe FRICS.
Whilst at Wilks Head & Eve he was accepted as a member of the Pyramus & Thisbe Club,
which was established in London in 1974 for surveyors and members of other professions
with an interest in party wall matters to exchange knowledge and experience.
In 1987 he became a professional associate, now termed a member, of the Royal Institu-
tion of Chartered Surveyors in the Building Surveying Division, through external examina-
tion. He is now a member of the RICS Faculties of Building Surveying, Construction, Dis-
pute Resolution and Geomatics.
In 1987 he became an Associate of the Chartered Institute of Arbitrators through interview
and acceptance of his experience in and knowledge of arbitration.
In 1988 he started work on his own account establishing David Bowden & Associates.
In 2006 he became a founding director of Urban Building Surveyors Limited, a company
regulated by the RICS and specialising in all matters relating to construction work in prox-
imity to adjoining land.
Party wall matters form about two thirds of his work.
This  involves not only the application of the statutory code but also identification of build-
ing defects, often several and up to a hundred metres away from building operations, and
their cause to enable a fair judgment to be made as to liability, and often interpretation of
symptoms of latent defects as well as ancillary, usually oral and occasionally inaccurate,
evidence from the parties regarding defects claimed to have arisen from a building opera-
tion.
In addition to the application of the statutory code now contained in the Party Wall etc Act,
1996 and previously Part VI of the London Building Acts (Amendment) Act, 1939, regard-
ing works in proximity to boundaries and structures outside a site, he has worked on other
matters associated with construction work in the urban environment such as noise and vi-
bration, their effects on people and structures and their control both under statute and in
tort, rights to light and other easements such as rights of way.
Since 1978 he has worked continuously mainly in London but as far afield as Manchester
and Plymouth.

He has written several papers in his specialist area and two have been published in Struc-
tural Survey, a peer reviewed academic journal.
He has prepared and given talks in particular aspects of his specialist area on several oc-
casions, by request of different branches of the Pyramus & Thisbe Club, in Surrey, Suffolk,
and Manchester.
He has researched and prepared question papers on the more obscure aspects of party
wall legislation for the Pyramus & Thisbe Club National Conferences in London.
He has also re-written and edited, with others, the RICS Practice Statement and Guidance
Note on Construction Works under the Party Wall etc Act 1996.
